These Terms of Service ("Terms") govern your use of FreeGen (the "Service"), a free AI image generation service. By using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

FreeGen lets you generate images from text descriptions using third-party AI models. The Service is provided free of charge, without registration, and is supported by advertising.

2. Fair Use

"Unlimited" means we do not sell tiers, credits, or subscriptions. To keep the Service free and available to everyone, we apply reasonable technical fair-use measures (such as rate limiting) that prevent abuse, automated scraping, and bulk generation by scripts or bots. Automated or programmatic access to the Service is not permitted.

3. Acceptable Use

You agree NOT to use the Service to create content that:

• Is illegal or promotes illegal activity
• Depicts or sexualizes minors in any way
• Is intended to harass, defame, or threaten a real person
• Impersonates a real person in a misleading or harmful way (including deceptive "deepfakes")
• Infringes intellectual property rights of others
• Constitutes spam, malware distribution, or fraud

Prompts are additionally filtered by the safety systems of our AI model providers, and requests that violate their content policies may be rejected.

4. Your Content

You own the prompts you submit. Subject to applicable law and the policies of the underlying AI model providers, you may use the images you generate for personal or commercial purposes. You are solely responsible for how you use generated images and for ensuring your use complies with applicable laws.

5. Nature of AI-Generated Content

AI-generated images may be inaccurate, unexpected, or resemble existing works or persons unintentionally. The Service provides no guarantee of accuracy, uniqueness, or fitness for any particular purpose.

6. Availability

We aim to keep the Service running, but it is provided "as is" and "as available", without any uptime guarantee. We may modify, suspend, or discontinue the Service (in whole or in part) at any time without notice.

7. Advertising

The Service displays third-party advertising. We are not responsible for the content of third-party ads or the websites they link to.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. AS THE SERVICE IS FREE, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED TEN (10) US DOLLARS.

10. Indemnification

You agree to indemnify and hold us harmless from any claims arising out of your use of the Service or your violation of these Terms.

11. Age Requirement

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the consent of a parent or guardian.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. Continued use of the Service after changes means you accept the updated Terms.
